Expert Witness

During my fifteen (15) year career with the Board of Funeral Directors and Embalmers, I was often asked for help, and by virtue of my position, I could not provide it. Now I can.

The funeral industry has a great need for a liaison between the funeral home and the Funeral Licensing Division of DCA. Licensees are overwhelmed by the requirements necessary to transfer a license, change the name of an establishment or location. They are frustrated by the process and would embrace a chance to "let an expert do it". Since I live near the state office, I will be able to closely monitor the application process and advise the applicant accordingly. There is a need for my services, and they will benefit the industry and DCA.

I hope to work with funeral directors needing advice and guidance managing their firms' preneed trust programs. I am an expert on California preneed trust law; my services would be invaluable. I do not intend to prepare annual preneed reports, however, I will review them for compliance. I will also work with funeral directors who need assistance bringing trusts into compliance.

I am a resource for individuals and corporations who are actively acquiring properties. My accumulated knowledge is invaluable when considering an acquisition. I am available to review a potential seller's records and audit their preneeds in a manner tailored to the purchaser's needs.

I am a consultant for licensees in need of compliance reviews. I am familiar with the Funeral Directors and Embalmers Law and rules of the Federal Trade Commission. The application and interpretation of rules regarding price disclosure, trust agreements, preneed contracts etc., are confusing and often violated as a result. Recently, heavy fines and/or litigation have been levied on firms out of compliance. If the funeral directors had a better understanding of the requirements, both could have been averted.

The industry is severely lacking in expert witnesses. My credentials establish my expertise and juries will not be prejudiced by testimony from "another funeral director".
